서비스 이용약관

1. 목적과 적용

이 약관은 칸데(CANDE)(이하 “회사”, 사업자등록번호 798-35-01563)가 제공하는 정병발사 앱과 관련 서비스의 이용 조건, 회사와 이용자의 권리·의무를 정합니다. 개인정보 처리에 대해서는 별도의 개인정보처리방침이 적용됩니다.

이용계약은 이용자가 약관에 동의하여 서비스 이용을 신청하고 회사가 이를 승낙할 때 성립합니다. 홈페이지를 열람한 것만으로 유료 구매나 약관 동의가 이루어지지 않습니다.

2. 서비스의 성격

정병발사는 이용자가 선택한 AI 친구 1–3명과 감정을 나누고 반응을 받는 채팅 서비스입니다. AI 친구는 실제 사람이 아니며, 응답은 부정확하거나 상황에 맞지 않을 수 있습니다.

서비스는 의료·심리 진단, 치료, 전문 상담 또는 응급 대응을 제공하지 않습니다. 회사가 대화를 실시간으로 사람이 감시하거나 긴급기관에 자동 신고하는 서비스도 아닙니다. 즉각적인 위험이 있다면 앱의 응답을 기다리지 말고 112·119 등 해당 지역의 긴급기관에 도움을 요청하세요.

3. 가입과 계정 관리

서비스는 Google 또는 Apple 로그인을 통해 이용하며, 이용자는 본인이 사용할 권한이 있는 계정을 사용해야 합니다. 정병발사는 만 14세 미만에게 제공하지 않습니다. 미성년자의 유료 구매 등 법정대리인 동의가 필요한 행위는 해당 동의를 받아야 합니다.

이용자는 계정 접근수단을 안전하게 관리하고 도용이 의심되면 회사에 알려야 합니다. 회사는 합리적인 보안 확인을 요청할 수 있습니다. 회사의 귀책사유까지 이용자에게 전가하지 않습니다.

4. 대화와 저장

이용자는 AI 친구의 닉네임·이미지·성향을 설정하고 대화방을 만들 수 있습니다. 대화와 설정은 로그인한 계정에 저장되며, 캐시와 서버의 상태나 네트워크 상황에 따라 표시가 지연될 수 있습니다. 실시간 다기기 동기화를 보장하지 않습니다.

타인의 개인정보나 민감정보를 입력하지 마세요. AI가 만든 내용은 사실 확인과 적절성을 스스로 검토한 뒤 사용해야 합니다. 서비스는 특정한 답변, 감정 변화 또는 문제 해결 결과를 보장하지 않습니다.

5. 무료 이용과 이용권

무료 제공량, 유료 상품의 가격·기간·횟수·유효기간 및 제한은 앱과 구매 화면에 표시합니다. 현재 무료 대화는 계정당 하루 10회이며 한국 시간(Asia/Seoul) 자정에 초기화되고 남은 무료분은 이월되지 않습니다.

사용자 메시지 한 건에 대한 AI 그룹 응답 요청을 1회로 계산하며, 선택한 친구 수에 따라 같은 요청을 중복 차감하지 않습니다. 무료분을 먼저 사용한 다음 활성 구독 또는 구매 대화권을 사용합니다. 서버가 실패 또는 안전 안내로 처리한 요청에서 차감된 이용분은 반환합니다. 이는 현금 환불과 구별됩니다.

이용권을 임의로 현금화·양도하거나 중복 적립할 수 없습니다. 유료 상품의 변경은 이미 구매한 권리를 부당하게 소급하여 축소하지 않도록 처리합니다.

6. 구독, 결제와 복원

유료 상품을 제공하는 경우 결제는 App Store 또는 Google Play를 통해 처리합니다. 구매 전 표시되는 가격, 결제주기, 포함 혜택과 자동 갱신 조건을 확인하세요. 구독은 스토어에 표시된 갱신 조건에 따라 자동 갱신되며, 갱신 전 해당 스토어에서 해지할 수 있습니다.

앱 삭제, 로그아웃 또는 서비스 계정 삭제만으로 스토어 구독이 해지되지 않습니다. 구매 복원 기능은 같은 스토어 계정의 복원 가능한 구독에 적용됩니다. 소모성 추가 대화권은 일반적인 스토어 복원 대상이 아니며 서비스 계정의 지급·사용 기록으로 확인합니다.

7. 청약철회와 환불

이용자는 관계 법령에 따라 계약내용을 받은 날 등 법정 기산일부터 원칙적으로 7일 이내에 청약철회를 할 수 있습니다. 디지털콘텐츠의 제공이 시작된 경우 등에는 법이 허용하는 범위에서 제한될 수 있으며, 이 경우 회사는 구매 전에 제한 사유와 필요한 동의·시험이용 절차를 제공합니다. 제공되지 않은 가분적 부분에 대한 권리는 별도로 판단합니다.

표시·광고 또는 계약내용과 다르게 이행된 경우에는 공급받은 날부터 3개월 이내, 그 사실을 안 날 또는 알 수 있었던 날부터 30일 이내 등 법정 요건에 따라 철회·환불을 요청할 수 있습니다. 법정대리인의 동의 없이 이루어진 미성년자의 거래는 법령에 따라 취소될 수 있습니다.

환불은 구매한 스토어의 신청 절차 또는 푸터의 문의 이메일를 통해 요청할 수 있습니다. 회사는 거래 확인과 필요한 스토어 취소·환급 절차에 협조하고 법정 처리기한을 따릅니다. 스토어 정책을 이유로 법률상 보장된 권리를 배제하지 않습니다. 단순히 “사용한 상품”이라는 이유로 모든 환불을 일률적으로 거절하지 않습니다.

8. 금지행위와 이용 제한

• 타인의 계정 도용, 결제 부정 사용, 이용권·시스템 취약점 악용
• 불법행위, 위협, 스토킹, 폭력·자해·보복을 실행하거나 돕기 위한 이용
• 타인의 개인정보·권리 침해, 불법 콘텐츠 업로드
• 자동화된 과도한 요청, 보안 우회, 서비스 운영 방해

회사는 위반의 정도와 반복 여부에 맞춰 경고, 요청 제한, 일시 정지 또는 계약 해지를 할 수 있습니다. 가능한 경우 사유와 기간을 알리고 소명·이의제기 기회를 제공합니다. 긴급한 보안·안전 위험은 먼저 제한하고 이후 안내할 수 있습니다. 위험한 표현에 안전 안내를 제공하는 것 자체를 곧바로 계정 제재와 동일하게 취급하지 않습니다.

9. 콘텐츠와 지식재산권

이용자가 입력하거나 업로드한 콘텐츠의 권리는 원래 권리자에게 남습니다. 회사는 저장, 전송, AI 응답 생성, 안전 처리 등 서비스 제공에 필요한 범위와 기간에 한해 이를 처리할 수 있습니다. 별도 동의 없이 이용자의 대화를 광고 소재로 공개하지 않습니다.

회사 고유의 코드·디자인·상표에 관한 권리는 회사 또는 정당한 권리자에게 있습니다. AI 출력의 독점성이나 제3자 권리 비침해를 보장하지 않으며, 출력 이용 시 타인의 권리를 존중해야 합니다. 법령상 허용되는 이용은 제한하지 않습니다.

10. 중단, 변경과 탈퇴

회사는 유지보수, 장애, 외부 제공자 문제 또는 운영상 필요한 사유로 서비스를 변경하거나 일시 중단할 수 있습니다. 예정된 주요 변경은 미리 알리고, 긴급한 장애는 가능한 때에 사유와 대응을 안내합니다. 유료서비스 종료 시 미제공 부분은 법령과 계약에 따라 정산합니다.

이용자는 푸터의 문의 이메일로 탈퇴와 계정 삭제를 요청할 수 있습니다. 회사는 본인 확인 후 관련 절차를 진행하며, 법정 보존 정보와 삭제 범위는 개인정보처리방침을 따릅니다. 미사용 유료분의 권리나 환불 요청은 탈퇴만으로 자동 소멸하지 않습니다.

11. 책임과 분쟁

회사와 이용자는 자신의 귀책사유로 상대방에게 손해를 입힌 경우 관계 법령에 따라 책임을 부담합니다. 회사의 고의·과실에 따른 책임이나 소비자에게 법률상 보장된 권리를 배제하지 않습니다. 통제할 수 없는 사유에 대한 책임은 원인과 예방·대응 조치 등을 고려하여 법령에 따라 판단합니다.

문의와 이의제기는 푸터의 문의 이메일로 접수합니다. 당사자는 분쟁 해결을 위해 협의할 수 있으며, 해결되지 않는 경우 소비자분쟁조정 등 법정 절차를 이용할 수 있습니다. 대한민국 법률을 기본으로 하되 이용자에게 적용되는 강행법규를 배제하지 않으며, 관할은 민사소송법 등 관계 법령에 따릅니다.

12. 약관 변경과 시행일

회사는 약관을 변경할 경우 내용, 사유와 적용일을 홈페이지 또는 앱에 미리 공지합니다. 일반 변경은 적용일 7일 전, 이용자에게 불리하거나 중요한 변경은 30일 전부터 알리는 것을 원칙으로 하고 필요한 경우 개별 통지 또는 별도 동의를 받습니다. 이용자는 변경에 동의하지 않으면 계약을 해지할 수 있으며, 아무 행동을 하지 않았다는 이유만으로 법률상 필요한 동의를 대체하지 않습니다.

시행일: 2026년 10월 1일. 영문본은 이용 편의를 위한 번역이며, 해석 차이가 있으면 강행법규에 반하지 않는 범위에서 한국어본을 기준으로 합니다.

1. Purpose and application

These terms govern Jeongbyeong Balsa and related services provided by 칸데(CANDE) (“Cande”), business registration number 798-35-01563. Personal-data processing is described in the separate Privacy Policy.

A service contract is formed when you apply after accepting the terms and Cande accepts the application. Merely reading the website does not constitute acceptance or a paid purchase.

2. Nature of the service

Jeongbyeong Balsa is a reaction chat with 1–3 AI friends you select. They are not real people, and generated responses may be inaccurate or inappropriate to the situation.

The service does not provide medical or psychological diagnosis, treatment, professional counseling or emergency response. It is not monitored in real time by people for emergencies and does not automatically report to emergency services. In immediate danger, contact local emergency services, such as 112 or 119 in Korea, without waiting for the app.

3. Accounts and eligibility

Sign in with a Google or Apple account you are authorized to use. The service is not offered to children under 14. Minors must obtain guardian consent for purchases or other acts where legally required.

Keep account access secure and report suspected misuse. Cande may request reasonable security verification. Users do not assume liability for Cande’s own fault.

4. Chat and storage

You can choose AI friend names, images and personalities and create rooms. Conversations and settings are stored for your signed-in account. Network, cache and server conditions may delay updates; real-time multi-device synchronization is not guaranteed.

Do not submit another person’s personal data or sensitive information. Check generated content before relying on or using it. The service does not guarantee a particular answer, emotional outcome or solution.

5. Free use and credits

Free allowances and paid prices, duration, quantities, expiry and limitations are shown in the app and purchase screen. The current allowance is 10 conversations per account per day, resetting at midnight Asia/Seoul. Unused free allowances do not carry over.

One group response request to one user message counts as one use, regardless of the number of selected friends. Free allowances are used before an active subscription or purchased credits. Uses deducted for requests the server handles as failures or safety notices are restored. Restoring a use is distinct from a cash refund.

Credits cannot be independently cashed out, transferred or fraudulently duplicated. Product changes will not unfairly reduce acquired rights retroactively.

6. Subscriptions, payment and restoration

Where paid products are offered, payments are processed through the App Store or Google Play. Review the displayed price, billing period, benefits and renewal conditions before purchase. Subscriptions renew under the store’s stated conditions and can be canceled in the store before renewal.

Uninstalling, logging out or deleting the service account does not cancel a store subscription. Purchase restoration applies to eligible subscriptions under the same store account. Consumable credits are not normally restored through store restoration; their allocation and use are checked against the service account records.

7. Withdrawal and refunds

Subject to applicable law, you may generally withdraw within 7 days of the legally specified starting date, such as receiving the contract information. Limits may apply when digital supply has begun only where legally permitted and after the required advance notice, consent and trial-access measures. Rights for undelivered divisible portions are considered separately.

For supply inconsistent with the advertised or agreed terms, statutory remedies may be available within 3 months of supply or 30 days after discovering or reasonably being able to discover the issue, subject to legal conditions. A minor’s transaction without required guardian consent may be canceled as provided by law.

Use the purchasing store’s refund procedure or the contact email in the footer. Cande assists with verification and required cancellation/refund actions within statutory deadlines. Store policies do not override mandatory consumer rights, and prior use alone does not justify rejecting every refund.

8. Misuse and restrictions

• Unauthorized account access, payment fraud or exploitation of credits or vulnerabilities
• Use to carry out or assist unlawful activity, threats, stalking, violence, self-harm or retaliation
• Violation of privacy or other rights; unlawful uploads
• Excessive automated requests, security circumvention or disruption

Depending on severity and repetition, Cande may warn, limit requests, suspend access or terminate the contract. Where possible, we explain the reason and duration and provide an opportunity to respond or appeal. Urgent security or safety risks may be restricted first and explained afterward. A safety response to a risky expression is not automatically an account sanction.

9. Content and intellectual property

Rights in submitted content remain with its original rights holder. Cande may process it only within the scope and duration necessary for storage, transmission, AI generation, safety and service provision. Conversations will not be publicly used as advertising without separate consent.

Cande’s code, designs and marks belong to Cande or their lawful owners. AI output is not guaranteed exclusive or free of third-party rights; respect others’ rights when using it. Legally permitted uses remain unaffected.

10. Changes, interruption and account closure

Maintenance, outages, external-provider problems or operational needs may require changes or interruptions. Planned material changes will be announced in advance; urgent issues will be explained as soon as practicable. Undelivered paid services will be settled under the contract and applicable law if service ends.

You can request account closure through the contact email in the footer. We verify identity and follow the Privacy Policy for deletion and statutory retention. Account closure does not automatically extinguish rights to unused paid service or refund claims.

11. Liability and disputes

Each party is responsible under applicable law for damage attributable to its own fault. Cande does not exclude liability for its intentional or negligent conduct or mandatory consumer rights. Responsibility for events beyond reasonable control is assessed under law, taking causes and preventive and response measures into account.

Submit questions and appeals through the contact email in the footer. Parties may seek an agreed solution or use statutory consumer mediation and other remedies. Korean law generally applies without excluding mandatory protections applicable to the user. Jurisdiction is determined by applicable procedural law, not an exclusive forum imposed by these terms.

12. Amendments and effective date

Changes, reasons and effective dates will be announced on the website or in the app. We generally give at least 7 days’ notice for ordinary changes and 30 days for adverse or material changes, with individual notice or separate consent where required. You may end the contract if you do not accept changes. Silence does not replace legally required consent.

Effective date: October 1, 2026. This English translation is for convenience. If interpretation differs, the Korean text prevails to the extent consistent with mandatory applicable law.
